Disclaimer: This is a template for operational use. Final legal review by a Zimbabwean attorney is required. Must comply with Consumer Protection Act [Chapter 14:44], ZIMRA regulations, and CVR requirements.
"Auctioneer" means BidUp Marketplace. "Buyer" means successful bidder. "Hammer Price" means final bid accepted. "Reserve" means confidential minimum price. "CVR4" means Change of Ownership form.
All auctions governed by Zimbabwe law. Consumer Protection Act cooling-off rights apply to private buyers (7 days). Commercial buyers are excluded. ZIMRA VAT and presumptive tax obligations apply where relevant.
Bidders must provide National ID/Passport, proof of residence, and pay refundable $100 USD bidding deposit. BidUp verifies identity via KYC. Bidding constitutes legal offer to purchase.
Vehicles must be: (a) less than 10 years old per SI 59/2026 unless exempt, (b) duty fully paid with proof, (c) ZRP police clearance valid, (d) roadworthy or sold "as is" with disclosure. Sellers warrant clear title, no encumbrances.
English ascending auction online. 5-minute anti-sniping: any bid in final 5 minutes extends auction by 5 minutes. Bids are in USD or ZiG at daily RBZ interbank rate +2%. Bids are binding.
Seller may set reserve. If not met, vehicle is "passed in". BidUp may negotiate post-auction within 48 hours.
Buyer pays: Hammer price + 8% buyer's premium (capped $800) + $50 documentation fee + ZINARA transfer $30. Seller pays 5% commission (capped $500). All payments via BidUp escrow.
BidUp lodges CVR4 with Central Vehicle Registry. Seller must sign CVR4 and provide copy of ID. ZIMRA 14-day change of ownership notification is mandatory per seller. Buyer receives registration book within 14 working days after payment clearance.
Risk passes to buyer on full payment. Vehicle must be collected within 72 hours from designated yard (Harare/Bulawayo). Storage $20/day after.
Per CPA Section 56, private consumers may cancel within 7 days if vehicle not collected and misrepresentation proven. Does NOT apply to commercial entities or auctions where reserve met and correctly described.
Buyer default: deposit forfeited, vehicle re-listed, buyer liable for deficiency. Seller default: $500 penalty, listing removed. BidUp reserves right to ban.
Personal data processed per Zimbabwe Data Protection Act. ID numbers encrypted. Vehicle history retained 7 years for ZIMRA audit.
Laws of Zimbabwe. Disputes: mediation first, then Harare Magistrates Court jurisdiction.
Buyer Terms & Conditions — Zimbabwe
All buyers must complete KYC: National ID/Passport, proof of residence, verified mobile. A refundable USD $100 bidding deposit is required to activate bidding. Deposit returned within 3 business days if no purchase.
Each bid is a legally binding offer under Zimbabwean law. Do not bid unless you have funds and intend to complete purchase.
Winning bid plus 8% buyer's premium (capped at $800 USD), $50 documentation fee, and ZINARA transfer $30. All fees payable within 24 hours via BidUp escrow (USD cash, ZiG at RBZ+2%, or bank transfer).
Full payment due within 48 hours of auction close. Failure = deposit forfeited, account suspension, liability for re-listing shortfall.
Vehicles sold as inspected and described. 15+ photos, video, and seller disclosure provided. Physical inspections available at Harare/Bulawayo yards by appointment. No warranty implied unless stated.
Private buyers have 7-day cooling-off right under CPA Section 56 ONLY if: (a) vehicle not collected, AND (b) material misrepresentation proven. Does not apply to commercial buyers, vehicles sold "as is" with disclosed defects, or where reserve met.
BidUp lodges CVR4 with Central Vehicle Registry within 5 working days of cleared payment. Buyer receives registration book within 14 working days. ZIMRA 14-day notification handled by seller via BidUp.
Collect within 72 hours from designated yard after payment confirmation. Bring ID and proof of payment. Storage charged at $20/day after 72 hours. Risk transfers on collection.
Report issues within 24 hours of collection with photos. Mediation first, then Harare Magistrates Court. BidUp holds funds in escrow until dispute resolved.
Shill bidding, bid shielding, or collusion results in permanent ban and forfeiture. All bids logged with IP and device fingerprint.
